The entire transaction of buying a new Flat/Unit from the Builder / Promoter, is now governed by The Real Estate (Regulation and Development) Act, 2016, and the various Rules made thereunder. Not only the transaction of purchase but also the entire project handling has to be done in the purview of RERA Act and Rules. Therefore, understanding the provisions of the RERA Act and Rules are important while purchasing Flat/Unit from any Builder / Promoter. Based on your requirements, we assist in the following steps –
Document Verification –
In this process, we check all the documents related to the Project and FLat/Unit including the documents provided by you and the documents submitted by the Builder/Promoter on the official website of RERA. After verifying all the documents, we provide an appropriate opinion with respect to the Project and the Flat/Unit.
Agreement Review –
The Agreement for Sale to be executed and registered for purchasing such FLat/Unit is also governed by the RERA Act and Rules. We review the said Agreement and all the clauses therein in the light of RERA Act and Rules and provide a detailed Report with our inputs and suggestions to you.
Preparation of Power of Attorney –
In case parties are not in Pune and they want to register the Agreement in their name, we assist in the preparation of the Power of Attorney and do the required legal process.
Registration of Agreement –
Usually, this process is done by the developer or builder but that is not mandatory and if parties want us to assist in the registration process then we provide this service too. Once the parties finalize the agreement we take an appointment in the sub-registration office as per the convenience of our client and assist personally in the process of registration.
RERA Litigation –
Under the said RERA Act, a RERA Authority has been formed and it has jurisdiction over all the disputes arising between the Flat/Unit Purchaser and the Builder/Promoter with respect to RERA Registered Projects (Ongoing and Completed). We assist you by providing an initial opinion as to your dispute and also represent you before the RERA Authority ( RERA Court).
