Power of Attorney for Gift Deed in Maharashtra
A Gift Deed is a legal document that allows an owner to transfer a property or any valuable asset to another person without any consideration or payment in return. In Maharashtra, the process of executing and registering a Gift Deed can be done through a Power of Attorney, which allows a person to act on behalf of the property owner who is not physically present in the state. This is especially useful for those who are living in another state of India or in a different country altogether.
To execute and register a Gift Deed through a Power of Attorney, the first step is to prepare the Power of Attorney document. This document must clearly state the purpose of the Power of Attorney, which in this case is to execute, present and admit the execution of a Gift Deed in the sub-Registration office for registration, and the person who is being granted the authority to act on behalf of the grantor. The document should also clearly specify the limitations of the authority granted, such as the type of property that can be gifted and the property description.
Important Points
For those who stay in other states of India –
Once the Power of Attorney document is prepared, it must be executed by the Grantor, it must also be stamped with the required Stamp Duty as per the state rules where it is getting registered. After the Power of Attorney document is executed and stamped, it must be registered at the sub-registration office where the grantor is located. The person who is being granted (attorney) the authority to act on behalf of the Grantor can then execute the Gift Deed on behalf of the Grantor using the Power of Attorney.
For those who are staying outside of India –
Once the preparation and execution of the Power of Attorney document is done, the Grantor must get it attested by the Indian embassy or consulate in the country where the Grantor is located. The attested Power of Attorney can then be sent to the person in Maharashtra who will execute the Gift Deed on behalf of the grantor. In this case Stamp Duty of Rs. 500/- must be paid within 4 months from the date of such executed Power of Attorney outside of India.
Conclusion –
In conclusion, the process of executing a Gift Deed in Maharashtra through a Power of Attorney is a convenient option for those who are not physically present in the state. With proper documentation and adherence to state rules and regulations, the Gift Deed can be registered smoothly and efficiently.
